Terms of Service

These Terms of Service ("Terms") govern your use of Tindral, operated by Tindral ("we", "us", "our"). By creating an account or using Tindral you agree to these Terms. If you do not agree, do not use Tindral.
1. Accounts
You must provide accurate information when you create an account, keep your login details secure, and be responsible for activity under your account. You must be at least 18 years old and authorised to act for your business. You are responsible for your team members' use of the service.
2. Early access
Tindral is provided on an early-access basis. Features may change, break, or be added or removed, and the service may be unavailable at times. We may modify or discontinue the service, or any feature, at any time. We recommend you keep your own copies of important records.
3. Your responsibilities and compliance
Tindral is a tool that helps you record job information and generate documents from the data you enter. You are solely responsible for:
- the accuracy and completeness of the information you enter;
- holding all licences, registrations, and insurance required for your work;
- reviewing every document Tindral generates, including treatment reports and certificates, before you rely on, issue, or send it; and
- ensuring your records and documents meet the legal, regulatory, and standards obligations that apply to your business.
Documents described as "aligned" with a standard (for example AS 3660.2) are formatted to assist you, and we do not warrant that any document satisfies a particular regulator, standard, council, or audit. We do not provide legal, compliance, accounting, or professional advice.
4. Acceptable use
You must not use Tindral to break the law, infringe others' rights, upload malicious code, attempt to gain unauthorised access, interfere with the service, or use it to store or send unlawful content. You must not resell or provide the service to third parties except your own staff.
5. Your data
As between you and us, you own the data you enter into Tindral. You grant us the licence needed to host, process, and display that data to provide the service and to generate your documents. You are responsible for the lawfulness of the data you enter, including personal information about your customers.
6. Our intellectual property
We own Tindral, including the software, design, branding, and templates. These Terms do not transfer any of our intellectual property to you. The Tindral name and logo may not be used without our permission.
7. Fees
Tindral is free to use while it is in early access. We may introduce paid plans in the future. If we do, we will give you reasonable notice before any charges apply to your account, and you may choose to stop using the paid features rather than be charged.
8. Third-party services
Tindral relies on third-party services and may link to or integrate with them. We are not responsible for third-party services, and your use of them may be subject to their own terms.
9. Consumer guarantees and warranties
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies to you and cannot lawfully be excluded. Subject to that, and to the maximum extent permitted by law, Tindral is provided "as is" and "as available", and we exclude all other warranties, express or implied.
10. Limitation of liability
To the maximum extent permitted by law, and subject to section 9, we are not liable for any indirect, incidental, special, or consequential loss, or for loss of profits, revenue, data, goodwill, or for any regulatory penalty, fine, or third-party claim arising from your use of Tindral or from any document generated using it. Where our liability cannot be excluded but can be limited, our total liability is limited, at our option, to resupplying the service or paying the cost of having it resupplied. While Tindral is provided free of charge, our aggregate liability to you is limited to AUD 100.
11. Suspension and termination
You may stop using Tindral and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably need to protect the service or other users. On termination your right to use Tindral ends. We will make your data available for a reasonable period where practicable before deletion, subject to any legal retention requirements.
12. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and change the "Last updated" date. If a change is material we will take reasonable steps to notify you. Continued use after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that place.
